Application for a new Premises Licence - 17 Breck Road, Poulton-le-Fylde

Minutes:

The Corporate Director Environment submitted a report to provide members of the Licensing Sub-Committee with information to assist them at a hearing to determine an application for a new Premises Licence in respect of 17 Breck Road, Poulton-le Fylde, FY6 7AA.

 

The Senior Licensing Officer informed the Sub-Committee that the applicant wished to create a licensed restaurant on the ground floor of the premises catering for around 50 covers, which would be open to the public between 10:00 and 23:00 on each day of the week. As an award-winning chef, the main focus of the business would be the food and the applicant wished to sell alcohol between 12 noon and 22:30 to diners and those ordering take away food.

 

The Senior Licensing Officer said that this matter was before the Sub-Committee because representations objecting to the new premises licence application had been received as detailed in Appendix 3 and 4 to the report. The Senior Licensing Officer informed the Sub-Committee that it had come to light that two of the objections to the application had been fraudulent.

 

The Senior Licensing Officer stated that the objectors had been given the opportunity to attend this meeting to speak and that they had not responded to her invitation. Details of how to access the meeting remotely had also been included on the agenda.

 

The Sub-Committee considered in accordance with Regulation 20 of The Licensing Act 2003 (Hearings) Regulations 2005 whether the meeting should proceed in the absence of the objectors or if it might be necessary to adjourn the hearing in the public interest. Members were satisfied that the objectors had been given appropriate notice of the hearing as required by Regulations 6 and 7 of The Licensing Act 2003 (Hearings) Regulations 2005 and decided to proceed in their absence. Details and copies of all the objections received were included in the report.

 

A complete list of all the conditions that the licence would be subject to if granted was reproduced at Appendix 9 of the report.

 

The applicant, Mrs Dalvi, spoke briefly in support of the application. She said that it was intended that the primary objective of the business would be for food, with the serving of drinks very much secondary to its main purpose as an eatery.

 

Mrs Dalvi responded to questions by members of the Sub-Committee which were mainly focused on the provision of CCTV in the alleyway between the premises and the Lemon Tree restaurant.

 

Members then considered the application in a private session.

 

Decision

 

The Licensing Sub-Committee’s decision and reasons to be sent to the applicant and objectors was that a new Premises Licence be granted in respect of 17 Breck Road, Poulton-le Fylde, FY6 7AA subject to the existing conditions outlined in the report together with an amendment to the condition in respect of the CCTV system by the installation of an additional camera in the alleyway. Condition 11 (ii) listed in Appendix 9 of the report would be amended accordingly.

 

The Licensing Sub-Committee in reaching this decision considered that the granting of the licence subject to the conditions referred to was appropriate for the promotion of the licensing objectives and would adequately address the concerns referred to in the objections regarding the prevention of crime and disorder and public nuisance.
