CAB.13

Exclusion of public and press

In accordance with Paragraph 11 of the Access to Information Rules in Part 4 of the Council’s Constitution, the Chief Executive has determined that the report submitted under item 5 of this agenda is “Not for Publication” because it refers to “exempt information” as defined in Part 1 of Schedule 12A(3) of the Local Government Act, 1972 as amended by the Local Government (Access to Information) Variation Order 2006, on the grounds that it contains information relating to the financial or business affairs of a particular person (including the authority holding that information).

It may provide information about the commercial dealings of the Council and affect negotiating situations. This information is not publicly available from the statutory registers of information kept in respect of certain companies and charities. In all the circumstances, it is therefore considered to be in the public interest for this report to be treated as exempt from publication as the public interest in maintaining the content of the report and appendices as exempt from publication outweighs the public interest in disclosing the information.

If Cabinet agrees that the public and press should be excluded for this item, it will need to pass the following resolution:

“That the public and press be excluded from the meeting whilst agenda item 5 is being considered, as it refers to exempt information as defined in category 3 (Information relating to the financial or business affairs of any particular person (including the authority holding that information)) of Part 1 of Schedule 12(a) of the Local Government Act, 1972, as amended by the Local Government (Access to Information) Variation Order 2006 and the public interest in maintaining the exemption outweighs the public interest in disclosing the information”.

Minutes:

The Chief Executive had determined that in accordance with Paragraph 11 of the Access to Information Rules in Part 4 of the Council’s Constitution, the report submitted under item 5 of this agenda was “Not for Publication” because it referred to “exempt information” as defined in Part 1 of Schedule 12A(3) of the Local Government Act, 1972 as amended by the Local Government (Access to Information) Variation Order 2006, on the grounds that it contains information relating to the financial or business affairs of a particular person (including the authority holding that information).

Decision

Cabinet agreed that the public and press be excluded from the meeting whilst agenda item 5 was being considered, as it referred to exempt information as defined in category 3 (Information relating to the financial or business affairs of any particular person (including the authority holding that information)) of Part 1 of Schedule 12(a) of the Local Government Act, 1972, as amended by the Local Government (Access to Information) Variation Order 2006 and the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
