Public questions

To receive and respond to any questions from members of the public.

 

Public questions for Cabinet may be submitted at any time by writing to Democratic Services or via email democratic.services@wyre.gov.uk. Public questions for this meeting must be received by noon on the Thursday before the meeting is held and do not need to specifically relate to items on this agenda. Questioners should provide their name and address and indicate to which Cabinet member the question is to be directed.

 

The total period of time allocated for public questions will not normally exceed 30 minutes.

Exclusion of the public and press

If the discussions during item 7 of this agenda involves the disclosure of “exempt information”, as defined in Schedule 12A of the Local Government Act 1972 and the Cabinet wishes to move the confidential session, it may at any point pass the following resolution: “That the public and press be excluded from the meeting whilst the agenda item is considered, on the ground that their presence would involve the disclosure of exempt information as defined in category 3 (Information relating to the financial or business affairs of any particular person, including the authority holding that information) of Part 1 of Schedule 12(a) of the Local Government Act, 1972, as amended by the Local Government (Access to Information) Variation Order 2006 and, Public Document Pack that in the public interest in maintaining the exemption outweighs the public interest in disclosing the information”.

The Chief Executive had determined that in accordance with Paragraph 11 of the Access to Information Rules in Part 4 of the Council’s Constitution, the report submitted under item 7 of this agenda was “Not for Publication” because it referred to “exempt information” as defined in Part 1 of Schedule 12A(3) of the Local Government Act, 1972 as amended by the Local Government (Access to Information) Variation Order 2006, on the grounds that it contains information relating to the financial or business affairs of a particular person (including the authority holding that information).

 

Decision

 

Cabinet agreed that the public and press be excluded from the meeting whilst agenda item 7 was being considered, as it referred to exempt information as defined in category 3 (Information relating to the financial or business affairs of any particular person (including the authority holding that information)) of Part 1 of Schedule 12(a) of the Local Government Act, 1972, as amended by the Local Government (Access to Information) Variation Order 2006 and the public interest in maintaining the exemption outweighed the public interest in disclosing the information.

Councillor Peter Le Marinel, Planning Policy and Economic Development Portfolio Holder and Marianne Hesketh, Director of Communities submitted a report to consider and recommend the contents of the Authorities Monitoring Report 2023-2024.

 

Councillor Le Marinel introduced the report and thanked officers.

Cabinet agreed:

 

  • That subject to the inclusion of any minor editorial alterations, the Draft Authorities Monitoring Report 2023-2024 as set out in Appendix 1 be approved by Cabinet and made available for public inspection.

Councillor Lesley McKay, Resources Portfolio Holder and Marianne Hesketh, Director of Communities submitted a report to seek approval to proceed with the purchase of Garstang Swimming Pool from Lancashire County Council.

 

Councillor McKay introduced the report and confirmed that she was supportive of the proposal.

 

Decision

 

Cabinet agreed:

 

  • That approval is given to acquire Garstang Swimming Pool and the surrounding land from Lancashire County Council.
