Minutes: The Corporate Director Environment submitted a report to provide members of the Licensing Sub-Committee with information to assist them to consider two objection notices received from Environmental Health and Lancashire Police, who are Relevant Persons under the 2003 Licensing Act (the Act) to allow them to decide whether or not to serve a counter notice on the event organiser in accordance with Section 105 of the Act. The objections were to a proposed temporary event, scheduled to run from Saturday 4 July to Friday 10 July at Trapps Farm in Thornton.
The meeting on 8 June 2020 was adjourned at 7.21pm due to technical issues and resumed at 6pm on 10 June 2020. Over the course of the meeting, the Sub-Committee considered the following documents:

In reaching its decision, the Sub-Committee had regard to:
1. The Licensing Act 2003 (the Act), 2. The Guidance published by the Secretary of State under s182 of the Act, 3. The Council’s Licensing Policy, 4. Human Rights Act 1998.
Decision
After due deliberation, the Sub-Committee concluded that granting the application would undermine the prevention of public nuisance and considered that it was appropriate for the promotion of this licensing objective, to issue a counter notice under section 105 of the Licensing Act 2003.
